Professor Todd Aagaard, whose scholarship focuses on environmental law, co-authored a July 10 New York Law Journal op-ed with Joel Eisen of the University of Richmond Law School on the EPA's recently announced Clean Power Plan.
Entitled “Tackling Climate Change: Don't Forget Energy Efficiency,” the piece outlined the importance of demand response strategies—which involve programs to reduce electricity consumption at specific times of high demand—in reducing emissions and in improving the efficiency of the electrical grid. Profs. Aagaard and Eisen argued that that while the legal basis for implementing demand-side measures will be hotly contested in the future, the EPA and the Federal Energy Regulatory Commission should be applauded for proposing innovative approaches to a difficult problem.
